Frequently Asked Questions
How is overtime pay calculated?
Overtime pay = Overtime Hours x (Regular Rate x Overtime Multiplier). The standard multiplier is 1.5x for hours over 40/week. If you earn $20/hour and work 45 hours: Regular pay ($800) + Overtime pay (5 x $30 = $150) = $950 total.
Is overtime calculated daily or weekly?
Federal law (FLSA) calculates overtime weekly: hours over 40 per workweek. Some states like California also require daily overtime: 1.5x for hours 8-12 and 2x for hours beyond 12 in a single day. Check your state's laws.
Can my employer avoid paying overtime?
Employers cannot avoid overtime for non-exempt employees. However, they can manage schedules to minimize overtime hours. Misclassifying employees as exempt to avoid overtime is illegal and results in back-pay penalties.
